These terms set the rules for using the Dinezyy app and the website dinezyy.com. They are the terms of service required by the Polish Act of 18 July 2002 on providing services by electronic means.
Dinezyy is provided by the operator named above. You can reach us at hello@dinezyy.com.
You can read, save and print these terms free of charge at any time at dinezyy.com/terms.
2. Definitions
Dinezyy, we, us: the operator named at the top of these terms.
You: a person who uses the app or the website.
Consumer: a consumer as defined in article 22¹ of the Polish Civil Code.
App: the Dinezyy mobile app for iOS and Android.
Account: your account in the app.
Restaurant: a restaurant listed in the app. Each restaurant is an independent business.
Booking request: your request for a table at a restaurant for a date, a time and a party size.
Booking: a booking request the restaurant has accepted.
Offer: the discount a restaurant gives on its bill through Dinezyy, with the days and hours it runs.
Bill: the bill a restaurant issues in Dinezyy for your visit.
Points: the Dinezyy loyalty points described in section 9.
3. What Dinezyy does
Dinezyy is free for diners. In the app you can:
browse restaurants, their menus and their offers;
send booking requests, and change or cancel them;
show an arrival code at the restaurant;
see the bill the restaurant issues, and pay it in the app or at the restaurant;
earn and use points;
receive messages about your bookings, bills and points, and marketing emails only if you agree to them.
The website tells you about Dinezyy. You can browse it without an account; that service ends when you leave the website.
Our agreement for the app starts when you create an account and lasts until the account is deleted.
The meal is between you and the restaurant. The restaurant is responsible for its food and drink, its service, its menu and allergen information, its prices and its premises, and for any fiscal receipt or VAT invoice for the meal. Dinezyy is not a party to that sale.
4. Technical requirements
To use the app you need:
a smartphone with a version of iOS or Android the app supports, and the current version of the app;
an internet connection;
a mobile number that can receive text messages, and an email address or an Apple or Google account;
a camera, only if you want to add a bill photo.
To use the website you need an up-to-date web browser.
Using any online service carries risks, such as malware, phishing or someone else getting into your phone. Keep your phone locked and up to date, and never share your sign-in codes. Dinezyy will never ask you for a sign-in code.
5. Your account
You must be at least 18 to create an account.
You sign up with your mobile number and a code sent by text message, then your email address and a code sent to it, or with Apple or Google and then your mobile number. You also give your name.
Give true details and keep them up to date. An account is for one person. Keep your phone and email secure, because whoever can receive your codes can use your account.
If you prove a phone number or email address that another Dinezyy account already holds, the two accounts are joined into one, with their points, bookings and history.
How we handle your personal data is explained in our privacy policy.
6. Booking requests
You choose a restaurant, a date, a time and a party size, and send a booking request. A request is not a confirmed table: the restaurant accepts or rejects it. If it rejects it, the app shows you the reason.
If you send a new request to the same restaurant for the same day, it replaces your earlier request that is still waiting. A request the restaurant has not answered within an hour after the requested time is cancelled automatically.
Once a request is accepted, the app gives you an arrival code: a QR code and a six-character code. Show it at the restaurant and the staff check you in. The code works until an hour after the booked time. If nobody checks in by then, the booking is cancelled automatically.
You can change or cancel a request or a booking in the app until you are checked in, free of charge. After check-in it can no longer be changed or cancelled.
A restaurant may cancel a booking it has accepted. If it does, we tell you and show you the reason.
7. Offers and the bill
A restaurant’s offer is a percentage off the whole bill, or separate percentages off food and drinks, on certain days and at certain hours. The restaurant page shows the offer and when it runs.
The offer applies to your bill when your booking was accepted, you were checked in, and the booked time is within the offer’s days and hours. Your bill is priced with the offer as it was when you booked, even if the restaurant changes it later. Otherwise there is no discount.
After your meal, the restaurant issues your bill in Dinezyy. The app shows the bill, the discount and what you pay. If something looks wrong, ask the staff: they can correct a bill that is not yet paid.
All amounts in the app are in Polish złoty (PLN). The price-level sign on a restaurant shows how expensive it is, in the currency of the restaurant’s country.
8. Paying the bill
You choose how to pay:
In the app, by BLIK or card. Payments are processed by our payment provider, a licensed payment institution, and Dinezyy receives the payment on the restaurant’s behalf. You can also use points (section 9).
At the restaurant, to the staff, by cash or card. The staff then mark the bill as paid in Dinezyy.
You can add a photo of your printed bill. It is optional and earns bonus points (section 9).
9. Points
You earn points:
1 point for every 5 zł you pay, whether in the app or at the restaurant. This counts what you actually pay, after the discount and after any points, rounded to the nearest point;
20 points for paying in the app;
20 points for adding a bill photo;
50 points once, when you join.
Points for a payment in the app arrive with the payment. Points for a payment at the restaurant arrive when the staff confirm it.
You can use points only in the app, on a bill you pay in the app, in steps of 100 points. 100 points are worth 10 zł off the bill, and points can cover the whole bill. Points cannot be used at the restaurant’s till, paid out in cash or given to another person.
Points do not expire.
If a payment is refunded, the points earned on that bill are removed and the points you used on it are returned. If you have already spent the points earned on it, your balance does not go below zero: the difference is taken from the next points you earn, and until then you cannot use points.
Points obtained in breach of these terms may be removed. Points end when your account is deleted.
10. Refunds
A payment made in the app can be refunded only by Dinezyy, and only in full. Restaurants cannot refund through the app. If you think a payment should be refunded, write to us at hello@dinezyy.com.
A refund returns the money to the way you paid and the points you used, and removes the points that bill earned. We tell you in the app and by email.
A payment made at the restaurant is between you and the restaurant.
11. Complaints
You can complain about the app, your account, booking requests, payments in the app or points by email to hello@dinezyy.com. Please include your name, the email or phone number on your account, what happened, and what you would like us to do.
We reply within 14 days of receiving your complaint, by email.
Complaints about the food, drink or service go to the restaurant. If you send one to us, we pass it on.
If you are a consumer, you have the rights the law gives you when a digital service does not match the agreement. These terms do not limit them.
12. Right of withdrawal
If you are a consumer, you can withdraw from the agreement for the app within 14 days of creating your account, without giving a reason, by writing to us at hello@dinezyy.com or by deleting your account in the app. It costs you nothing.
A table at a restaurant for a set date is a catering service, so the statutory right of withdrawal does not apply to it (article 38(1)(12) of the Polish Consumer Rights Act). You can still cancel a request or a booking in the app until you are checked in.
13. Our responsibility
We work to keep Dinezyy available and correct. The app or website may sometimes be unavailable, for example during maintenance or after a failure, and we work to restore it quickly.
We are not responsible for what restaurants do: whether they accept a request, whether they cancel a booking, their food, drink and service, or the information they give about their menus and venues.
If you are a consumer, nothing in these terms limits our responsibility where the law does not allow it to be limited.
14. What you must not do
When you use Dinezyy, you must not:
post unlawful or offensive content, including in booking notes;
send booking requests you do not mean to keep, or book in someone else’s name without their agreement;
add a bill photo that is not of your bill;
create several accounts, or misuse offers or points in any other way;
interfere with the app or the website, copy their content at scale, or use bots or automated tools on them;
pretend to be someone else, or harass restaurant staff.
15. Ending the agreement
You can delete your account at any time in the app, under Profile, free of charge. You can’t delete it while a request is waiting, a booking is accepted or checked in, or a bill is unpaid. When the account is deleted, your personal data is erased and your points end. Records of bills and payments that we must keep for accounting are kept without anything that identifies you.
We may end your account if you seriously breach these terms, for example by fraud or by repeatedly doing what section 14 forbids. We tell you why by email and give you 14 days’ notice, unless the breach needs us to act at once.
16. Changes to these terms
We may change these terms for an important reason, such as a change in the law, a change to Dinezyy’s services or to points, or security. We tell you by email and in the app at least 14 days before a change takes effect. If you do not agree, you can delete your account before then.
17. Law and disputes
These terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory law of the country where you live.
Disputes go to the court that has jurisdiction under the general rules. If you are a consumer in Poland, you can also ask for free help or out-of-court resolution from your municipal or district consumer ombudsman (rzecznik konsumentów) or the regional Trade Inspection (Inspekcja Handlowa). More information is at prawakonsumenta.uokik.gov.pl.
Ten regulamin określa zasady korzystania z aplikacji Dinezyy i strony dinezyy.com.
2. Definicje
Dinezyy, my: operator wskazany na początku regulaminu.
Konsument: konsument w rozumieniu art. 22¹ Kodeksu cywilnego.
Aplikacja: aplikacja mobilna Dinezyy na iOS i Androida.
Konto: Twoje konto w aplikacji.
Punkty: punkty programu lojalnościowego Dinezyy opisane w punkcie 9.
3. Co robi Dinezyy
Dinezyy jest bezpłatne dla gości. W aplikacji możesz:
przeglądać restauracje, ich menu i oferty;
wysyłać prośby o rezerwację, zmieniać je i odwoływać;
pokazać w restauracji kod wejścia;
zobaczyć rachunek wystawiony przez restaurację i zapłacić go w aplikacji albo w restauracji;
zbierać i wykorzystywać punkty;
4. Wymagania techniczne
Do korzystania z aplikacji potrzebujesz:
smartfona z wersją iOS lub Androida obsługiwaną przez aplikację oraz aktualnej wersji aplikacji;
dostępu do internetu;
numeru komórkowego, który odbiera SMS-y, oraz adresu e-mail albo konta Apple lub Google;
Blokuj telefon, aktualizuj go i nigdy nie podawaj nikomu kodów logowania. Dinezyy nigdy nie poprosi Cię o kod logowania.
5. Twoje konto
Podawaj prawdziwe i aktualne dane.
Wybierasz restaurację, dzień, godzinę i liczbę osób, i wysyłasz prośbę o rezerwację.
Pokaż go w restauracji, a obsługa Cię wpuści.
7. Oferty i rachunek
Oferta restauracji to rabat procentowy na cały rachunek albo osobne rabaty na jedzenie i napoje, w określone dni i godziny. Strona restauracji pokazuje ofertę i to, kiedy obowiązuje.
Oferta obejmuje Twój rachunek, gdy rezerwacja została przyjęta, zostałeś wpuszczony lub zostałaś wpuszczona do restauracji, a zarezerwowana godzina mieści się w dniach i godzinach oferty. Rachunek liczymy według oferty z chwili rezerwacji, nawet jeśli restauracja później ją zmieni. W innym wypadku rabatu nie ma.
Po posiłku restauracja wystawia Twój rachunek w Dinezyy. Aplikacja pokazuje rachunek, rabat i kwotę do zapłaty.
8. Płacenie rachunku
Sam wybierasz, jak zapłacić:
W aplikacji, BLIK-iem lub kartą. Płatności obsługuje nasz dostawca płatności, licencjonowana instytucja płatnicza, a Dinezyy przyjmuje płatność w imieniu restauracji. Możesz też użyć punktów (punkt 9).
W restauracji, obsłudze, gotówką lub kartą. Obsługa oznacza wtedy rachunek w Dinezyy jako zapłacony.
Możesz dodać zdjęcie wydrukowanego rachunku. Jest dobrowolne i daje dodatkowe punkty (punkt 9).
9. Punkty
Punkty dostajesz:
1 punkt za każde 5 zł, które płacisz, w aplikacji albo w restauracji. Liczy się kwota faktycznie zapłacona, po rabacie i po punktach, zaokrąglona do pełnego punktu;
20 punktów za płatność w aplikacji;
20 punktów za zdjęcie rachunku;
Informujemy Cię o tym w aplikacji i e-mailem.
Płatność w restauracji to sprawa między Tobą a restauracją.
11. Reklamacje
Jeśli wyślesz je do nas, przekażemy je dalej.
Jeśli jesteś konsumentem, przysługują Ci uprawnienia, które prawo daje w razie braku zgodności usługi cyfrowej z umową. Regulamin ich nie ogranicza.
13. Nasza odpowiedzialność
Dbamy o to, żeby Dinezyy działało i podawało prawidłowe informacje.
14. Czego nie wolno robić
Korzystając z Dinezyy, nie wolno:
dostarczać treści bezprawnych lub obraźliwych, także w uwagach do rezerwacji;
wysyłać próśb o rezerwację, z których nie zamierzasz skorzystać, ani rezerwować na kogoś bez jego zgody;
dodawać zdjęć, które nie przedstawiają Twojego rachunku;
zakładać kilku kont ani w inny sposób nadużywać ofert lub punktów;
zakłócać działania aplikacji lub strony, masowo kopiować ich treści ani używać na nich botów i narzędzi automatycznych;
17. Prawo i spory
Regulamin podlega prawu polskiemu. Jeśli jesteś konsumentem, zachowujesz ochronę, którą dają Ci bezwzględnie obowiązujące przepisy kraju, w którym mieszkasz.
Spory rozstrzyga sąd właściwy według przepisów ogólnych. Jeśli jesteś konsumentem w Polsce, możesz też skorzystać z bezpłatnej pomocy lub pozasądowego rozwiązania sporu u miejskiego lub powiatowego rzecznika konsumentów albo w wojewódzkim inspektoracie Inspekcji Handlowej.
